1. Acceptance of Terms

  • By accessing or using Dawaisarthi (“the Platform”), you agree to be bound by these Terms of Service and all applicable laws and regulations.
  • If you do not agree with any part of these terms, you may not use the Platform.
  • These terms apply to all visitors, registered users, and anyone who accesses or uses our services.

2. Eligibility

  • You must be at least 18 years old to use Dawaisarthi.
  • By using the Platform, you represent that you have the legal capacity to enter into a binding agreement.
  • We reserve the right to refuse service to anyone for any reason at any time.

3. Account Registration

  • You may browse the Platform without registering. An account is required to place orders and track purchases.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must immediately notify us of any unauthorised use of your account at support@dawaisarthi.in.
  • We reserve the right to terminate accounts that violate these terms or are used fraudulently.

4. Orders and Purchases

  • All orders are subject to product availability and verification of payment.
  • Prices displayed on the Platform are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
  • We reserve the right to cancel or refuse any order if we suspect fraud, stock errors, or incorrect pricing.
  • For prescription medicines, a valid prescription must be uploaded and verified by our pharmacist before processing.
  • Once an order is confirmed, it may only be modified or cancelled within 1 hour of placement.

5. Prescription Medicines

  • Certain medicines on our Platform are classified as ‘prescription only’ under Indian law (Schedule H / H1 drugs).
  • You agree to provide a genuine, valid prescription issued by a registered medical practitioner for such products.
  • Submitting a forged or invalid prescription is a violation of the Drugs and Cosmetics Act, 1940, and constitutes grounds for immediate account suspension and legal action.
  • Our pharmacists may contact you for clarification before dispensing prescription medicines.

6. Pricing and Payment

  • We accept Cash on Delivery (COD), UPI, and Credit/Debit card payments.
  • All online payments are processed through secure, PCI-DSS compliant payment gateways.
  • In the event of a duplicate charge, please contact us within 7 days for resolution.
  • Promotional prices and discounts are valid only for the specified period and cannot be combined unless stated.

7. Delivery

  • Delivery timelines are estimates and may vary due to factors beyond our control (extreme weather, local lockdowns, etc.).
  • Risk of loss or damage to products passes to you upon delivery.
  • If you are unavailable at the time of delivery, our logistics partner will attempt re-delivery up to two more times.

8. Returns and Refunds

  • Returns are accepted for damaged, expired, or incorrect items within 48 hours of delivery.
  • Opened or partially used medicines, items without original packaging, and temperature-sensitive products are not eligible for return unless damaged on arrival.
  • Approved refunds are credited to the original payment method within 5–7 business days.
  • To initiate a return, go to My Orders or contact support@dawaisarthi.in.

9. Intellectual Property

  • All content on the Platform — including logos, text, images, and software — is owned by or licensed to Dawaisarthi.
  • You may not copy, reproduce, distribute, or create derivative works without our express written consent.
  • User-submitted content (reviews, questions) is licensed to us on a non-exclusive, royalty-free basis.

10. Prohibited Conduct

  • You may not use the Platform for any unlawful purpose or in violation of these terms.
  • You may not attempt to gain unauthorised access to any part of our systems or data.
  • You may not engage in scraping, data harvesting, or any automated collection of content.
  • You may not impersonate another person or entity, or falsely state your affiliation with any person or entity.

11. Disclaimer of Warranties

  • The Platform and its content are provided on an ‘as-is’ and ‘as-available’ basis.
  • To the fullest extent permitted by law, Dawaisarthi disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.
  • We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

12. Limitation of Liability

  • Dawaisarthi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
  • Our total liability to you for any claim shall not exceed the amount you paid for the relevant order.

13. Governing Law

  • These terms are governed by and construed in accordance with the laws of India.
  • Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

14. Changes to Terms

  • We may modify these Terms of Service at any time. Changes take effect immediately upon posting.
  • Continued use of the Platform after changes constitutes your acceptance of the updated terms.
  • We will notify you of material changes by email or by a prominent notice on the Platform.
